Short answer

If you are a nonresident and rent out a property in the United States, by default the rent is taxed at a flat 30% on the gross amount (or a lower treaty rate), with no deductions. You can instead elect to treat the rental income as effectively connected with a U.S. business, under section 871(d). Then you deduct expenses and depreciation, pay tax on the net at graduated rates, and file Form 1040-NR every year.

The default rule: 30% on the gross

Without the election, the rent is treated as passive income. The tenant or the property manager, acting as withholding agent, should withhold 30% of each payment and send it to the IRS. No expenses are subtracted: not the mortgage interest, the property tax, the HOA, the management fee or the depreciation. On a property with high expenses, 30% of the gross can be more than the whole profit.

The election: pay on the net

With the 871(d) election, the rental income is treated as effectively connected income. That allows you to:

  • Deduct mortgage interest, property taxes, insurance, HOA fees, repairs, utilities and management fees.
  • Deduct depreciation of the building, which often reduces taxable income a lot.
  • Pay tax on the net income at the graduated rates, which start low.

To make it, you attach a statement to Form 1040-NR listing the properties, their location, ownership and income. The election stays in effect for later years until it is revoked, and revoking it later generally needs IRS approval.

Stopping the 30% withholding

Once you make the election, give your property manager or tenant Form W-8ECI. It certifies that the income is effectively connected and will be reported on your return, so the 30% withholding no longer applies. You must keep a valid form on file with them every year the election is in effect.

Deadlines for Form 1040-NR

  • If you have no U.S. wages and no U.S. office, the return is due by the 15th day of the 6th month after the year ends: June 15 for most people.
  • If you have wages subject to U.S. withholding or a U.S. office, it is due April 15.
  • Form 4868 gives an automatic extension if filed by the due date.

Important: to claim deductions against that income, the return must be filed on time. The IRS treats a 1040-NR as timely for this purpose if it is filed within 16 months of its due date. Waiting too long can mean losing all the deductions.

Other points to keep in mind

  • You need an ITIN to file Form 1040-NR if you do not have a Social Security number. You can request it with the first return; see our ITIN guide.
  • Florida does not have a personal income tax, but it does have sales and tourist development taxes on short-term rentals, which are separate.
  • When you sell, FIRPTA withholding applies; see our FIRPTA guide.

Respuesta corta
