Short answer
If your business sponsors a 401(k) or other qualified plan, a SEP or a SIMPLE IRA and something went wrong (eligible employees left out, deferrals above the annual limit, a missed required employer contribution), you can usually fix it before the IRS finds it. On October 22, 2026, the IRS published Revenue Procedure 2026-34, which replaces Rev. Proc. 2021-30 and is generally effective that same day. It confirms that many inadvertent errors can be self-corrected without paying any fee, as long as you have compliance procedures in place and you correct within the deadline.

The IRS correction system for retirement plans is called EPCRS (Employee Plans Compliance Resolution System). It has three programs:
- Self-Correction Program (SCP): you correct the error yourself, with no IRS filing and no fee.
- Voluntary Correction Program (VCP): you file Form 8950 through the Pay.gov website, pay a user fee and receive the IRS's approval of the correction. It is only available before the plan or the sponsor is under examination.
- Audit Closing Agreement Program (Audit CAP): if the IRS finds the error during an examination, you correct it, pay a negotiated sanction and sign a closing agreement.
Rev. Proc. 2026-34 brings into one document the changes made by the SECURE 2.0 Act of 2022 and the interim guidance the IRS issued since then (Notices 2023-43, 2024-2 and 2024-77). The same day, the IRS also published Rev. Proc. 2026-33, a separate correction system for IRAs, effective May 1, 2027.
What changes for a small business
More errors can be self-corrected
SCP now covers "Eligible Inadvertent Failures": errors that happen even though the business has practices and procedures (formal or informal) reasonably designed to keep the plan in compliance. This includes certain participant loan failures. A 401(k) no longer needs a favorable IRS letter to use SCP. Errors that are egregious, involve the diversion or misuse of plan assets, or are related to an abusive tax avoidance transaction are not eligible.
A clearer deadline
The correction must be completed within a reasonable period after you identify the error. It is treated as reasonable if you finish by the later of the last day of the third plan year after the plan year in which the error happened, or 18 months after you identified it. Once the plan or the business comes under IRS examination, this window generally closes, with limited exceptions such as insignificant operational failures.
SEP and SIMPLE IRA: the document matters
Self-correction is expanded for SEPs and SIMPLE IRA plans, but only if the plan document is a valid IRS model form (Form 5305-SEP or 5305A-SEP for a SEP, Form 5305-SIMPLE or 5304-SIMPLE for a SIMPLE IRA) adopted according to its instructions, or a prototype plan that has a current favorable opinion letter and has been amended as the IRS requires. Also, if too much was contributed to a SEP or SIMPLE IRA, SCP cannot be used with a method that leaves the excess in the IRA.
What still cannot be self-corrected
If the business never adopted a written plan in the first place, SCP is not available for that failure. The other routes in EPCRS are VCP (before an examination) or, if the IRS finds it during an examination, Audit CAP.
What to keep in your file
If the IRS examines the plan, you must be able to show documentation that:
- Identifies the error, the years involved, the number of employees affected and the date you found it.
- Explains how it happened and shows that you had compliance procedures in place at the time.
- Describes the correction method and the date you completed it.
- Lists the changes you made to your procedures so the error does not happen again.
What to do now
- Review your plan for 2025 and 2026: who was eligible, what was deposited and when.
- If you have a SEP or a SIMPLE IRA, confirm which document you signed when you opened it.
- Write down your procedures, even if they are simple, such as a yearly checklist with your payroll provider.
- If you find an error, correct it before the deadline instead of waiting for an IRS letter.
The IRS is accepting public comments on Rev. Proc. 2026-34 until January 20, 2027.

Respuesta corta

Proc. 2026-34 hasta el 20 de enero de 2027.
