How to ask the IRS to remove a penaltyCómo pedirle al IRS que te quite una multa

Many IRS penalties can be removed, but the IRS rarely does it on its own. You have to ask, with the right basis.

Short answer

The IRS can remove penalties for filing late, paying late and, for businesses, depositing payroll taxes late. The two most common routes are first-time abatement, for taxpayers with a clean record, and reasonable cause, when something outside your control prevented you from complying.

First-time abatement

You generally qualify if:

  • you had no significant penalties in the three tax years before the year of the penalty;
  • you have filed all currently required returns, or have a valid extension; and
  • you have paid the tax due, or have a payment plan and are current on it.

It also applies to the late-filing penalties of partnerships (Form 1065) and S-Corps (Form 1120-S) in many cases. Penalties for international information returns, such as Form 5472, generally do not qualify for first-time abatement, but they can be considered for reasonable cause.

Reasonable cause

You must show that you acted with ordinary business care and could not comply for reasons outside your control. Examples the IRS considers include a fire or natural disaster, a serious illness or death of the taxpayer or a close family member, and being unable to obtain the records needed. The explanation must be specific, with dates and documents that connect the event to the delay.

How to request it

  • Call the number on the notice; first-time abatement is often granted by phone.
  • Reply in writing to the notice with your explanation.
  • File Form 843, Claim for Refund and Request for Abatement.

If the IRS denies the request, you can appeal.

What happens to the interest

Interest on the tax itself is generally not removed. When a penalty is removed, the interest charged on that penalty is removed with it.

A strategic detail

First-time abatement can only be used once in the three-year window. If you have a solid reasonable-cause argument, it is sometimes better to use that first and save first-time abatement for another year.

Respuesta corta

  • no tuviste multas importantes en los tres años fiscales anteriores al año de la multa;

  • Presenta el Formulario 843 (Claim for Refund and Request for Abatement).
