I received an IRS CP2000 notice: what it means and what to doRecibí una carta CP2000 del IRS: qué significa y qué hacer

A CP2000 says the IRS believes you owe more tax. It is a proposal, not a final bill, and how you respond in the next 30 days makes the difference.

What a CP2000 is

A CP2000 is an underreporting notice. The IRS compares your return with the information it receives from employers, banks, brokers and payment platforms (Forms W-2, 1099-NEC, 1099-K, 1099-B, 1099-INT and others). When the numbers do not match, it sends a notice proposing changes to your tax, usually with interest and sometimes with a 20% accuracy-related penalty.

Two things to know from the start: it is not a bill, and it is not an audit. It is a proposal that you can accept, partially accept or dispute with documentation.

Why it usually happens

  • Stock or crypto sales reported without the cost basis: the IRS calculates tax on the full sale price, as if all of it were profit.
  • Freelance or platform income (1099-NEC, 1099-K) that was not reported, or was reported under a different name or business.
  • A forgotten W-2 from a short job, or a retirement account distribution (1099-R).
  • Interest or dividends (1099-INT, 1099-DIV) that did not make it into the return.
  • Income that belongs to someone else, or that was already reported in a different place on the return.

The deadline

The response date is printed on the notice, usually 30 days from the date of the letter (60 days if you live outside the United States). If you need more time to gather documents, you can request it by calling the number on the notice before the deadline.

How to respond

If you agree

Sign the response form, return it by the deadline and pay the amount, or request a payment plan if you cannot pay it all at once. You generally do not need to file an amended return for the items in the notice.

If you disagree, fully or in part

Mark the option that applies on the response form, attach a clear explanation and the documents that support your position, and send it by the deadline. Examples: the brokerage statement showing the cost basis, proof that the income was already reported, or documents showing the income belongs to another person. If the IRS accepts your explanation, it adjusts or closes the case. If it does not, you will receive a new letter, and you still have rights to appeal.

What happens if you do not respond

The IRS will send a Statutory Notice of Deficiency. From that point you have 90 days (150 days if the notice is addressed to you outside the U.S.) to file a petition with the U.S. Tax Court. If you do not, the tax is assessed and the collection process begins: balance-due notices, and eventually liens or levies. Responding to the CP2000 is almost always the fastest and least expensive way to resolve it.

Make sure the letter is real

The IRS starts contact by mail, not by text message, email or social media. If you have doubts, check your IRS Online Account or call the IRS using the phone number published on irs.gov, not one included in a suspicious message.

When to get help

If the amount is significant, the notice covers income you do not recognize, or you received more than one year of notices, it is worth having a professional review it. An Enrolled Agent can represent you before the IRS with Form 2848, prepare the response with the right documentation and deal with the IRS on your behalf.

Qué pasa si no respondes
